# NutsEmu End-User License Agreement (Beta)

Version 1.0, effective October 9, 2026

This agreement is between you and **Evan Bolton**, an individual doing business as Nuts Developing
("we", "us"). It covers the NutsEmu iPhone app, the NutsEmu Companion apps for Mac and Windows, and
their updates (together, the "Software"). By installing or using the Software you agree to it. If
you don't agree, don't install or use the Software.

## 1. What you get

1.1 **Licence.** While you have an eligible paid membership on our Patreon page
(patreon.com/NutsDeveloping) at the "NutsEmu Access" or "NutsEmu Priority Debugging" tier (or any
tier we later name as eligible), we grant you a personal, non-exclusive, non-transferable licence to
download, install and use the Software on devices you own or control, for your own non-commercial
use.

1.2 **After your membership ends.** You may keep and keep using the builds you downloaded while your
membership was active, under this agreement. You won't get new builds, downloads, updates or
support after it ends. Your rights in open-source components under §5 never end.

1.3 **Patreon tier benefits** (beta builds, update access, priority debugging, early builds,
Discord roles) are described in the tier listing on Patreon. They are not part of this licence and
may change as described there.

## 2. Intended use and audience

2.1 **A developmental prototype and proof of concept.** NutsEmu is a developmental prototype of a
Windows-to-iOS translation layer (Wine, FEX x86 translation and graphics translation to Metal). It
exists to show that this is possible on iPhone and how it can be done. It is shared with supporters
of its development for testing, research, learning and development, together with development logs.
It is not a finished consumer product, and it may never become one.

2.2 **Like a book for developers.** Think of NutsEmu as a book: developers are welcome to study it,
learn from it, and implement its workarounds, techniques and ideas in their own code, written by
them. What you may not do is copy our code itself (§3.3).

2.3 **Your device, your Apple ID.** You install the Software yourself and sign it with your own
Apple ID, on a device you own or control, for your personal use. You are responsible for complying
with the terms of Apple's developer program and agreements that apply to your account, and with the
terms of any third-party tools you choose to use with the Software, for example JIT or VPN helpers
such as LocalDevVPN, and sideloading tools. We don't operate or control those programs or tools.

2.4 This section describes who the Software is for. It does not limit your rights in open-source
components under §5.

## 3. Our proprietary parts

3.1 The Software's own code and assets (the NutsEmu app, its host and user interface, its
extensions, the `winenuts`, `nutsinput`, `nutsaudio`, `wmadmod`, `nutssteam` and `libvulkan_nuts`
modules, the Companion's own code, and the NutsEmu name and logo) are owned by us. All rights not
expressly granted are reserved.

3.2 **Studying it is fine.** You may inspect, analyse and reverse engineer the Software to learn how
it works, to debug it, or to make it work with other software. This agreement has no clause against
reverse engineering.

3.3 **Copying it is not.** Except as §5 allows, you may not:

- copy, reproduce or reuse our proprietary code, or substantial parts of it (including code
  recovered by decompiling or disassembling it), in any other software or product;
- build, publish or sell a product made from our proprietary code, or one that copies it;
- share, sell, rent, re-upload or otherwise distribute the Software, its installers, its IPA files
  or your download links;
- share your Patreon access or let others use your installer access;
- remove or alter copyright or license notices;
- use the Software to infringe anyone's rights (see §6).

The ideas, workarounds, techniques and knowledge you learn from studying the Software are yours to
use and implement in your own code, including in your own products. Our code is not.

## 4. Your device, Apple ID and accounts

4.1 The Software is installed by signing it with **your own Apple ID**. The Companion asks for your
Apple ID to create signing certificates and provisioning profiles in your account. You are
responsible for complying with Apple's terms for your account. Apple may limit or revoke apps signed
this way, and we cannot control that.

4.2 **Third-party sign-in service.** Apple sign-in in the Companion uses a third-party "anisette"
service (currently https://ani.stikstore.app), which we don't operate, to generate the device
authentication headers Apple requires. The Companion exchanges device provisioning data with that
service. Your Apple ID password is sent only to Apple, never to that service or to our update
server. If you choose "Remember", your sign-in is stored in your Mac's Keychain or in Windows
Credential Manager.

4.3 **Patreon sign-in.** The Companion uses Patreon's sign-in (OAuth) to check that your membership is
eligible. We receive your Patreon user ID and profile URL and, for your memberships, the patron
status, the amount you are currently entitled to, your entitled tiers and the campaign. We use them only
to check eligibility and do not store them. Our update service keeps Patreon's sign-in tokens for your
session (up to 30 days, or until you sign out) so it can re-check your membership before each download.
We do not receive your Patreon password or payment details.

## 5. Open-source components: your rights are not limited

5.1 The Software includes open-source components, listed in `THIRD-PARTY-NOTICES.md` and the
`licenses/` folder shipped with the Software. **Each of them is licensed to you under its own
license, not under this agreement.** Nothing in this agreement, in Patreon's Terms of Use or
member licence, or in any tier description restricts the rights those licenses give you. If
anything here conflicts with an open-source license for that component, the open-source license
wins.

5.2 **LGPL components.** NutsEmu uses Wine, vkd3d-proton, GnuTLS, libtasn1, libunistring, Nettle and
mini-GMP. The Companion uses apple-codesign-quick. These are covered by the GNU Lesser General
Public License, version 2.1 or 3 (copies included, with the GNU GPL version 3). **Regardless of
§3, you may:**
- modify those libraries, and modify the Software for your own use to work with your modified
  libraries;
- rebuild them, replace the copies in the NutsEmu app or the Companion with your modified
  versions, and re-sign the app with your own Apple ID to install it;
- relink the Companion's Apple sign-in helper with a modified apple-codesign-quick, using the
  materials we provide;
- relink DXMT's `winemetal.dll` with a modified Wine `winecrt0` library, using the object files
  we provide;
- **reverse engineer the Software to the extent needed to debug such modifications.**

We publish the complete corresponding source code of these libraries, our changes to them
(NutsEmu's changes to Wine, including NutsSync and the iOS compatibility layer, are licensed
under the LGPL 2.1 or later), the build scripts and the relinking materials at
**https://nutsdeveloping.com/source**, and we make the written offer in `SOURCE-OFFER.md`. Support
for modified builds is not included (§8), and the update service may decline to serve them.

5.3 This software uses code of FFmpeg (https://ffmpeg.org), licensed under the LGPLv2.1, as part
of Wine. We do not own FFmpeg. Its owners are listed in FFmpeg's source code at
https://nutsdeveloping.com/source.

## 6. No piracy, no games included

6.1 The Software is an emulator/compatibility layer. **It includes no games, no Windows
installation, no Microsoft software, no BIOS/firmware and no product keys.**

6.2 Use the Software only with programs and games **you own and have the right to run**. Do not use
it to run, share or obtain pirated software.

6.3 The Software is not designed to bypass copy protection or DRM, and you must not use it to do so.
Games run through their publishers' own clients and launchers (for example Steam), under those
services' terms.

6.4 We never ask for, receive or send game files, executables or keys. Bug reports must contain only
logs and descriptions. Don't send us copyrighted files.

6.5 Windows is a trademark of Microsoft Corporation, and Steam is a trademark of Valve Corporation.
Other names belong to their owners. We are not affiliated with or endorsed by them.

## 7. Payments and refunds

Payments are made to Patreon and governed by Patreon's Terms of Use
(https://www.patreon.com/policy/legal), including its refund policy. Nothing in this agreement
limits any refund or consumer rights you have under the law of the country where you live.

## 8. Beta software. No warranty.

8.1 The Software is **beta** software for testing and development. It may crash, lose saves or data,
drain battery, heat your device, or stop working after an iOS update or an Apple policy change.
Back up your data.

8.2 **THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT,** to the
extent the law allows. The open-source components come with the warranty disclaimers in their own
licenses.

8.3 **Limitation of liability.** To the extent the law allows, we are not liable for indirect,
incidental, special or consequential damages, or for lost data or profits. Our total liability is
limited to the amount you paid through Patreon for the Software in the 3 months before the claim.
Some places don't allow these limits, in which case they apply only as far as the law allows.

## 9. Updates and data

9.1 The Companion checks our update service for new builds and verifies your membership before a
download. NutsEmu may show update notices.

9.2 **Problem reports are optional.** NutsEmu never sends logs, crash reports or diagnostics on its
own. A report leaves your device only when you choose to send it ("Report a Problem", then Send
Report): it goes through nutsdeveloping.com to the NutsEmu Discord server's bug-reports channel,
as the Privacy Policy describes. Before a report is made, IP addresses
and email addresses are removed from the logs. Reports you send us, and the note you write in them,
are used only to develop and fix the Software, and we keep them for as long as they are needed for
that. You can ask us to delete a report you sent at any time (see §11, Contact).

9.3 **Privacy.** How we handle personal information is described in the NutsEmu Privacy Policy
(`PRIVACY.md`, in Settings → Licenses & Legal and on nutsdeveloping.com).

## 10. Termination

We may end this licence if you break it, for example by redistributing the Software, copying our
code or using it for piracy. On termination, stop using the proprietary parts. §§2, 3, 5, 6, 8, 10
and 11 survive. Your open-source license rights under §5 are not affected by termination.

## 11. General

- **Export:** you must comply with export-control and sanctions laws. The Software contains
  encryption (TLS libraries).
- **Governing law:** the State of Alabama, USA, courts of Dale County, Alabama.
- **Changes:** we may update this agreement for future builds. The version shipped with a build applies
  to that build.
- **Entire agreement:** this agreement, the open-source licenses in §5 and Patreon's Terms of Use are the
  whole agreement about the Software.
- **Contact:** evanbolton@nutsdeveloping.com.
